Accidents in Supermarkets due to Wet floor resulting in a claim!!

Hi,

I slipped on a wet floor and hurt my back. There were 3 witnesses but I was so shaken and in a lot of pain at the time the last thing I thought about was getting witness details. I did however fill in the accident book. I never thought about making a claim at first but 2 weeks later I am still in a lot of pain with my back. I have seen the doctor several times already and I am still being treated for the pain. I am self employed so cannot claim sick pay it has already cost me because I cannot work as normal plus the on going problems with my back. Is this something I can claim for?

The floor was wet which the witnesses picked up on, I am not sure if it had been washed or was because there had been rain (although it was dry at the time of the accident) there was no sign. I had just been walking round the shop. The shoes I was wearing were shoes I always wore and shoes I regularly wear in the shop.

I am not trying to make money. If the back injury had cleared up within a couple of days I would not even have thought about making a claim but the fact it is now 2 weeks on, I am still in a  lot of pain and have lost financially I feel perhaps I should claim?

    You would have to prove that the condition of the floor was slippery and this
    caused you to fall. It is a pity that you did not get the witness details, but I
    would still make a claim because you did report it and the accident book was
    completed and you are still suffering 2 weeks later.  The company will have to
    provide a copy of the accident book if you make a claim and this will help you prove
    your case. If the floor was wet due to rain, that is harder to win. Large shops
    should have means of wiping feet and train staff to watch out for the floor on rainy
    days. Smaller shops would not be expected to do that. It was not a wet day though,
    so probably someone had mopped the floor a few minutes before you went in the shop
    and they forgot to put a sign out.

Wet floors must be kept dry!! or Stop any rain water carried into the entrance.

All entrances should have the correct level of protection to prevent slips and falls, and the level of protection should depend on the volume of customer flow!
 
30.  It is not disputed that there were 3 large entrances to the Center, which are referred to in the evidence as the main entrances.  In addition, there are 4 other smaller exits.  In my Judgment, it is reasonable to expect anti-slip mats, prominent warning signs and umbrella bags to be put in place at all the entrances, including the smaller ones.  In addition, it is in my Judgment reasonable and appropriate for the large main entrances (where the traffic of people can be expected to be heaviest) to be manned by workers on rainy days, so that these workers can take adequate steps to keep the floor in the vicinity of the main entrances reasonably dry and safe for visitors, and to verbally alert visitors, if necessary, of the wet floor if it is not dried in time.

When it rains the entrance becomes slippy! high risk for slips and falls!

Every time it rained, the hall near the front entrance of the administration building would become very slippery. Everyone knew this hazard occurred, but the problem was never corrected. That is, until a secretary slipped and strained her wrist as she tried to catch herself.

Sainsbury’s Accident not my fault

 

Few days ago I had acccident in Sainsbury supermarket this was slip on wet floor there is'nt any sign that floor is wet.
What should I do to do compensation claim against Sainsburys ? Can I do that alone or should I get solicitor ?
They have insurance for that so this is not so hard to get compensation ?

Hi dont know if im posting in right place or not sorry if not. The thing is I was in tesco on thursday and as I left I fell on the wet floor, the mat was away from the door and the floor was soaked as the weather was terrible, obviously because it was at the door and with people in and out. But there was no wet sign up and it hadnt been dried up either. I obviously jumped up because I felt such a fool as Im 28 yrs old, a member of staff did come to see if I was ok but I was just so embarrassed I went on my way. I was not seriously hurt thankfully but my leg is covered in bruises, and no doubt the cameras will have taped the incident. Im just wondering if there's any thing I can do?? I mean I just sufferred bruising and major embarrasment, but if this was an elderly person it would of been a broken hip or worse, as it was painful for me and like I said Im 28. Anyway thanks for reading and any advise would be good.
 
If the sign not being there, for any reason, contributed to the incident then the store could be guilty of neglect, as might the slippery entrance/exit because their duty to keep it free of ALL hazards at ALL times is absolute

Nor is it up-to the victim to figure out what MIGHT have happened to any sign, windy or not

If a premises, including a private home or Supermarket are inviting members of the public to visit or enter their premises or home they have a duty of care to those visitors to ensure the pathways & entrances are clear at all times of any hazard & that includes a slippery surface..

Once you have notified the shop manager of your accident & if possible identified the staff member who came to your assistance you will then have to be medically examined by your GP

You will then have to decide whether or not to use a specialist personal injury solicitor who WILL, if they agree to take on your case, do it on the basis of a CFA which will, contrary to some ill-informed claims, cost you nothing.

However if your claim falls below a certain monetary level it will mean no claimant costs can be recovered & you then you may have to proceed yourself in which case just use this site where you will find guidance

slip on the wet floor in ASDA

 

Hi!
last week  I was going back from holiday and went to ASDA to do some shoping when I went in a shop, I sliped on the wet floor, there was no sign that it was wet.
I have broke my leg. I didn't raport it to the shop manager, but at plesce of accident there was a medical emergency who saw what had happend. I have witnesess - my wife and friend.
can I get compensation and who big it may be?

I went into my local asda supermarket and slipped on wet floor resulting in a swollen and bruised foot and ankle. I visited the local hospital who x rayed my foot and luckily it was not broken just badly sprained and was given advice to treat. When you walk into the store there is a rug about 1m by 1m then tiles. There were wet floor signs up but I only noticed them after falling as they were not by were I fell. I have since noticed the wet floor signs seem to be a perminant feature. It was logged in the accident book and a first aider applied a cold compress to my foot.

Hi, my boyfriend had an accident in the Electric Cinema in London. He went downstairs, slipped on a wet, very slippery floor and fell off stairs onto the floor once level below. unhappily he broke his collarbone and injured arm.  There was no information about a slippery surface. He took an X-ray of the his head, but it's right.Thomas was on sick leave three weeks Today hasn't work as normal plus the going problems with his head. He's a pain of head very oft. can we endeavour a claim against a ovner of cinema or against claning women. She didn't wash a floor but had a mop and a bucket with liquid. We didn't report the accident to the management of cinema.

The Co Op insurers make offer

 

My 5 year old daughter slipped on a wet floor in a branch of the CoOp some months ago and sustained an eye injury (bruising/swelling).The staff were indifferent and did not help at all or record the accident.The area manager stated the employee cleaning was not trained and no wrning signs were posted.They passed the nmatter to ther insurers (Zurich) who investigated and admitted liability offering �850 in compensation.I think this is ok for the bruisng etc.In any case 2 months afer sending a letter of acceptance they have not paid.I called a few times and was told by an emplyee the figure should be ratified at court?First time Ive heard of this.
Should I send a 14 day 'pay or else' letter and then reclaim this through the small claims court or is this not allowed? (I have done this online with bank charges).
